Terms of Service

These terms govern your use of agentcommunity.org and related services (“the Service”), operated by Open Agent Registry, Inc., a Delaware corporation (“we” or “us”). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. What the Service is

The .agent Community is a platform for people and organizations who want to support the creation of a .agent top-level domain for AI agents. The Service lets you:

  • Register as a community member (individual or organization)
  • Pre-register preferred .agent domain names
  • Sign the .agent Community Charter
  • Participate in the endorsement process, which may involve signing documents through DocuSeal, a third-party e-signature provider
  • Receive email updates about the community and the ICANN application

We are not a domain registrar. We do not sell domain names. The .agent TLD does not currently exist in the DNS. Everything related to .agent domains on this platform is contingent on ICANN approval, which is not guaranteed.

2. Pre-registration

Pre-registering a .agent domain name is free, non-binding, and does not guarantee that you will receive that name. It records your preference and gives you prioritized access if the TLD is approved and becomes operational.

Situations where you might not receive your pre-registered name include:

  • ICANN does not approve the .agent TLD application
  • Multiple members pre-register the same name (contested strings)
  • The name falls under a reserved or premium category defined by community policy
  • The name violates registration policies adopted by the community

Allocation rules for contested or premium names will be determined through community governance. We will publish these rules before any domain allocations take place.

3. The charter

During registration, you may be asked to agree to the .agent Community Charter. The charter outlines shared principles for the community. When you accept it, we record your IP address, a cryptographic hash of the charter version, and a timestamp. This is for legal validity and non-repudiation of the agreement. See our Privacy Policy for how we handle this data.

4. Accounts

You are responsible for keeping your account credentials secure. If you authenticate through Google or GitHub, those providers' terms and privacy policies also apply to the authentication step.

You must provide accurate information during registration. If we discover that your registration contains materially false information, we may suspend or terminate your account.

5. Acceptable use

Do not use the Service to:

  • Provide false or misleading registration information
  • Squat on domain names with no intent to use them for AI agents
  • Impersonate another person or organization
  • Interfere with the Service's operation or other users' access
  • Scrape, crawl, or bulk-download data from the Service without permission
  • Violate any applicable law

6. Email communications

By creating an account, you agree to receive transactional emails related to your membership (welcome messages, verification, endorsement requests). We may also send you occasional updates about the community and the ICANN application.

You can unsubscribe from non-transactional emails at any time using the unsubscribe link in any email, or by visiting /unsubscribe.

7. Document signing

Organizations participating in the endorsement process sign documents electronically through DocuSeal. By initiating the signing process, you authorize us to share your name, email, and organization details with DocuSeal for this purpose. DocuSeal's own terms and privacy policy apply to their processing of your data.

Signed endorsement documents are stored in our database and may be included in our ICANN application as evidence of community support.

8. Intellectual property

The Service's code, design, and content (excluding user-submitted data) belong to Open Agent Registry, Inc. or its licensors. The community's open-source projects are licensed under their respective open-source licenses, as indicated in each repository.

By submitting registration data, you grant us a license to use that data for the purposes described in these terms, including inclusion in our ICANN application. You retain ownership of your data.

9. What happens if ICANN does not approve

If the .agent TLD application is not approved, your account and registration data remain intact. We may pursue a future application window with the same community. You can request deletion of your data at any time regardless of the ICANN outcome.

10. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee that:

  • The .agent TLD will be approved by ICANN
  • You will receive any particular .agent domain name
  • The Service will be available without interruption
  • Pre-registration confers any legal right to a domain name

To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by Delaware law, Open Agent Registry, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of a desired domain name, loss of data, or loss of business opportunity.

Our total liability for any claim related to the Service will not exceed the amount you paid us in the twelve months before the claim arose. Since the Service is currently free, this amount is zero.

12. Indemnification

You agree to indemnify and hold harmless Open Agent Registry, Inc. and its officers, directors, and employees from claims, damages, and expenses (including reasonable attorney fees) arising from your use of the Service or your violation of these terms.

13. Termination

You can close your account at any time by emailing support@agentcommunity.org. We can suspend or terminate your account if you violate these terms, with or without notice.

On termination, your pre-registered domain names are released. Sections 8, 10, 11, 12, and 15 survive termination.

14. Changes to these terms

We may update these terms. If the changes are material, we will notify you by email or by posting a notice on the Service before the changes take effect. Continued use of the Service after the effective date means you accept the updated terms.

15. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

Before filing a lawsuit, you agree to try to resolve the dispute informally by emailing legal@agentcommunity.org. We will try to work it out within 30 days.

16. Miscellaneous

If any provision of these terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. These terms, together with the Privacy Policy and the .agent Community Charter, are the entire agreement between you and us regarding the Service.
